Bravicä Terms of Service

Please read these Terms of Service ("Terms") carefully before utilizing the services provided by Bravicä ("Company,""we," "us," or "our"). By engaging with our services, including but not limited to photography, videography, and graphic design, you ("Client," "you") agree to be bound by these Terms.

1. General Conditions

  • Right of Refusal: We reserve the right to refuse service to anyone for any reason at any time. This includes, but is not limited to, situations involving inappropriate, unsafe, or illegal conduct.

  • Modification of Terms: We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of our services after the posting of any changes constitutes acceptance of those changes.

2. Services, Pricing, and Payment

  • Service Agreement: All services, including scope, deliverables, timeline, and final pricing, will be outlined and agreed upon in a separate, formal Service Agreement or Contract specific to your project. These Terms supplement that agreement.

  • Pricing: All prices for our services are subject to change without notice. We will honor the price quoted in your specific Service Agreement once it is signed and a retainer has been paid.

  • Payment: A non-refundable retainer fee (or deposit), typically 50% of the total service cost, is required to secure your booking and/or begin work. The remaining balance is due on or before the date of service, or upon delivery of the final digital proofs/designs, as specified in the Service Agreement. We accept payment via methods outlined in the Service Agreement.

3. Cancellations, Rescheduling, and Refunds

  • Client Cancellation/Rescheduling:

    • If you need to cancel or reschedule a service/event, you must notify us in writing as soon as possible.

    • If you fail to follow through with a reservation (cancellation or rescheduling) less than 72 hours from the scheduled event or start date of the project, the retainer and any payments already made will not be refunded.

    • Cancellations or reschedules made more than 72 hours in advance may be subject to a refund of the balance paid, but the initial retainer remains non-refundable.

  • Company Cancellation: If Bravicä must cancel the service for reasons outside of our control (e.g., severe illness, equipment failure), we will issue a full refund, including the retainer, or work with you to reschedule the service to a mutually acceptable date.

  • No Show: If the Client fails to show up or communicate prior to the start time of a scheduled event or shoot, the full balance of the service fee is forfeited, and no refund will be issued.

4. Deliverables and Revisions

  • Finality of Product: Once final files (photos, videos, or designs) are delivered and approved, any subsequent requests for changes, revisions, or edits may be subject to additional hourly fees, as outlined in the Service Agreement.

  • Proofing and Approval: The Client is responsible for final proofing of all graphic design work (including text, colors, and layout). Bravicä is not liable for errors discovered after the Client has provided final written or digital approval for production or release.

5. Intellectual Property and Usage Rights

  • Copyright: Bravicä retains the full and complete copyright for all photographic images, video footage, and graphic design elements created.

  • Client Usage: Upon final payment, the Client is granted a non-exclusive, non-transferable license to use the final deliverables (e.g., photos, videos, designs) for the specific purpose outlined in the Service Agreement (e.g., personal use, business promotion). The Client may not resell the deliverables or claim them as their own original work.

  • Company Usage: Bravicä reserves the right to use any images, footage, or design elements created for the Client for our own portfolio, advertising, marketing, or self-promotion purposes, across all media, unless explicitly agreed upon otherwise in a separate written agreement.

6. Client Responsibility and Service Limitations

  • Cooperation: The Client agrees to cooperate with us and provide timely access to necessary information, personnel, and locations required to complete the services.

  • Safety: The Client is responsible for ensuring the safety of the working environment during a shoot or service performance. We reserve the right to terminate the service without refund if we feel our safety or equipment is at risk.

  • Guaranteed Delivery/Delay: While Bravicä strives to meet all deadlines, delivery timelines are estimates. We are not liable for reasonable delays caused by factors beyond our control, including but not limited to severe weather, necessary post-production time, or delays in Client feedback/approvals.

  • Force Majeure: Neither party shall be liable for any failure or delay in performance under these Terms (other than payment obligations) due to causes beyond its reasonable control, including but not limited to, war, natural disasters, epidemics, or government restrictions.

7. Limitation of Liability and File Storage

  • Limitation of Liability: In the unlikely event that services cannot be rendered due to unforeseen circumstances (e.g., equipment failure, loss of data), the liability of Bravicä shall be limited to a refund of the amount paid for the service. Bravicä will not be held liable for any indirect, incidental, or consequential damages.

  • Storage and Backup: Bravicä guarantees file backup and availability for final deliverables for a period of six (6) months following project completion. After this period, we are not responsible for the archival or retrieval of files, and clients are solely responsible for backing up their delivered files.

8. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
